What happens if you do not have an estate plan

If you die without a will, also known as dying intestate, the probate court usually divides your property among your immediate family.  This means you do not have a say in who receives your assets.

If you have a spouse and children, your spouse gets the first $50,000 plus one-half of the balance of your estate and the remainder goes to your children.  Otherwise, the court divides your estate between your spouse and your parents.  If you do not have a spouse or children, the estate will go to your parents.
